Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by ReQuest-IT (PTY) Ltd ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

ReQuest-IT provides software engineering and consultancy services, including but not limited to AI-Powered Development, API-Free MVPs, DevOps & Infrastructure, and Technical Consulting. The specific services to be provided will be outlined in a separate agreement or statement of work.

3. Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information as required for the provision of services
  • Cooperate with ReQuest-IT as necessary for the successful delivery of services
  • Review and provide feedback on deliverables in a timely manner
  • Pay all fees and charges as agreed upon in the service agreement
  • Comply with all applicable laws and regulations

4. Intellectual Property Rights

Unless otherwise specified in a written agreement, ReQuest-IT retains all intellectual property rights to the methodologies, processes, and tools used to provide services. Upon full payment, clients receive a license to use the deliverables for their intended purpose.

Any pre-existing intellectual property remains the property of its original owner. Each party agrees not to use the other party's intellectual property without prior written consent.

5. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the engagement. This includes business strategies, technical information, and any other non-public information.

6. Payment Terms

Payment terms will be specified in the service agreement. Unless otherwise stated, invoices are due within 30 days of issuance. Late payments may incur additional fees or result in suspension of services.

7. Limitation of Liability

To the maximum extent permitted by law, ReQuest-IT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

8. Termination

Either party may terminate the service agreement as specified in the contract. Upon termination, the client shall pay for all services rendered up to the termination date.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles.

10. Changes to Terms

ReQuest-IT reserves the right to modify these Terms of Service at any time. We will provide notice of significant changes. Your continued use of our services after such modifications constitutes your acceptance of the updated terms.
